The Minnesota Legislature right now is considering legislation to, not only decriminalize marijuana, but to legalize this intoxicating substance for recreational use and commercial production.

Advocates for marijuana reform contend that the prohibition on marijuana has brought too many people into traumatic encounters with the criminal justice system for minor offenses that present little risk to the public safety. Arguing that marijuana as an intoxicating substance is no more harmful than other substances, like alcohol and tobacco, that are legal for use in Minnesota, advocates suggest that regulation rather than criminalization would better address concerns. The movement for marijuana reforms also responds to popular demand for recreational use. Advocates believe that allowing regulated commercial production would enhance health and safety, displace the criminal black market, and provide significant tax revenue.

Opponents contend that marijuana presents risks and dangers to mental health beyond those presented by alcohol and other legal intoxicants. They fear that legalization would ease access to adolescents and introduce potency levels that would be far greater than for other substances. Questions are raised about the proper age for use, how to regulate intoxicating power, and how to address marijuana intoxication by drivers and in public settings. For these and other reasons, opponents argue that, while decriminalization may be justified, continued prohibition of commercial production for recreational use would better serve the public health and social development of young people.
