Bike Share Liability Form

Section 1

It is expressly agreed that the use and/or operation of any BEAST Bike Share Program bicycle by the undersigned (hereafter referred to as the “User”) is at the User’ sole risk and the User assumes any and all risk from the condition, use and/or operation of any BEAST Bike Share bicycle. It is further expressly agreed that BEAST, the Wellness Center, and the University of St. Thomas and its officers, representatives, employees, and agents, shall not be liable for any claims, demands, injuries, damages, actions, or causes of actions whatsoever to the User or and other personal arising out of or connected with the condition, use and/or operation of any BEAST Bike Share bicycle, and the User does hereby expressly forever release and discharge BEAST, the Wellness Center, and the University of St. Thomas from any and all claims, demands, injuries, damages, actions or causes of action, and from all acts, including acts of active or passive negligence, arising out of (i) the condition, use and/or operation of any BEAST Bike Share Program bicycle, or (ii) the BEAST Bike Share program. I agree to adhere to all legal mandates for the state of MN, and ride only on paved services. I agree to always secure the bike with the issued bike lock. Section 2:

 Loan Terms:

  • UST Bikes are available only to current UST faculty, staff, and students.
  • The standard loan period is 3 days.
  • If bike is not returned within 30 days of its due date the bike will be assumed as missing and the full cost of the bike will be charged to the patron.

 Fines and Replacement Costs:

  • Fines are $10.00 per day the bike is overdue.
  • Fines for overdue bikes will not be waived for faculty, staff or students.
  • Patrons will be charged for the replacement of bikes that are lost or damaged. The cost of replacement is $400.00 plus a $15.00 processing fee.
  • Parts that must be replaced will be charged to patrons as follows: Helmet $20; Key $10; Lock $30, etc.
  • The UST Libraries and the Bike Share program reserve the right to charge additional fees for damaged or negligent use of the bikes.

  • Overdue Notices will be sent to the patron’s UST email account.
  • Billing Notices will be sent to the patron’s primary home address, as defined by their UST record.
  • I agree that the bike I am borrowing is in safe working condition, including the tires, wheels, breaks, and shifters.
