This CLE will provide a brief overview of the history of Section 1983 and the civil rights issues related to cruel and unusual punishment (i.e., prisoner abuse actions).

Jeff Storms began his career at Oppenheimer Wolff & Donnelly before working as an associate and then partner at Gaskins Bennett Birrell Schupp LLP.  Jeff recently formed his own law firm, Newmark Storms Law Office.  His firm focuses on criminal defense, personal injury, and civil rights litigation.  Jeff has been named a “Super Lawyer,” and was named a 2013 “Attorney of the Year” by Minnesota Lawyer for his work on a $3.075 Million Dollar police brutality wrongful death—the second largest police brutality settlement in Minnesota history.  Jeff’s civil rights cases have been covered by the Washington Post, Star Tribune, St. Paul Pioneer Press, and KSTP.

This CLE, presented by Jeff Storms '06, will provide a brief overview of the history of Section 1983 and the civil rights issues related to cruel and unusual punishment (i.e., prisoner abuse actions).  The course will focus on the practical mechanics of pursuing a Section 1983 action under the 8th Amendment, including: (1) identifying the party or parties to sue; (2) considerations in drafting the complaint; (3) discovery considerations; and (4) the fee petition.
